It is felt that the state has been dawdling and reluctant in creating steps to protect and advance human rights, although it has created legal frameworks to that effect. It is also seen that the set of human rights legislations and regulations remain impotent, as mere legal norms. Instead of taking steps to resolve human rights violations in the past, in order to restore justice and create a new moral basis for the reforms in the legal and political systems, the state seems to be busy with elite disputes, as shown by the performance of the disoriented parliament. At the same time, the government compromises with actors from the former regime, still influential after all those years.

 

Thus, such a condition results in doubts on the future of the transition in the post-New Order era. With an apathetic parliament, and compromising executive, it is hard to imagine that Indonesia’s period of transition will be an actual transition towards democracy. As actors from the toppled regime are still active in the parliament and executive bodies, it is hard to imagine a clear vision on drawing a line separating the past and the future. And with such an unclear vision on separating the past and the future, it is also hard to imagine that there will be a guarantee that the authoritarianist practices of the past will not repeat in the future; nor that there will be a guarantee that the government will apply standards of protection for human rights as the prerequisite for a democratic political system.
